Brickyard Coalition Files Notice For $40M Claim Against BOE

A suit could follow if the County moves forward in selecting a vendor for the Brickyard Road Soccer Field Project, coalition leaders say.

The Brickyard Coalition filed legal notices with the Maryland State Treasurer Thursday for possible monetary claims against the Montgomery County Board of Education. The claims allege violations of citizens' rights in the controversy . 

"The notices state that the members of the Brickyard Coalition’s legal, property, civil and constitutional rights (both state and federal) were violated by the BOE’s egregious actions in regard to the Brickyard school site," the coalition announced. 

The notice is the first step required of citizens wishing to sue and seek monetary damages from the Board of Education or any of its officials. More than 400 individuals, as well as multiple civic organizations, filed the notice, and each claimant could receive up to $100,000, according to the coalition.

The coalition will move forward with the suit as a last resort, said coalition leader Curt Uhre.

"We didn't ask for this, but we will fight back with every bone in our body," Uhre said. "And if we need to file a lawsuit and it gets to that point with the board of education we certainly will do so."

That point could be when the county goes forward with awarding a vendor, he said.
